DEFINITIONS/TERMS

 

Petitioner:        The person filing the paperwork requesting involuntary drug/alcohol treatment for a loved one.

Respondent:     The person in need of involuntary drug/alcohol treatment.

Petition:           The formal legal application and paperwork for Casey’s Law

QHP:                Stands for Qualified Health Professional and refers to the professionally certified individuals required to complete the Casey’s Law certification forms.

Certification:    Legal forms that must be completed by the QHP.  Each professional must sign their form and have it notarized.  The signed form MUST be returned to the clerk’s office within 24 hours of its completion.

WHAT IS CASEY'S LAW?

 

Casey’s Law is a legal proceeding which results in a court order for involuntary treatment for addiction.

The Petitioner is responsible for all costs related to Casey’s Law including treatment and the circuit clerk will ask for a signature on a guarantee of payment for treatment.

HOW DO YOU BEGIN THE CASEY'S LAW PROCESS?

To ensure a successful application process, contact should be made with Meaghan Warsaw in the Jefferson County Attorney’s Office at (502) 574-6188 before filing a petition.  Casey’s Law can be a confusing procedure and failure to complete all of the steps within the proscribed deadlines will result in a dismissal of the case.  The Jefferson County Attorney’s Office is here to guide you and help you avoid potential pitfalls.

 

WHAT IS REQUIRED TO FILE A CASEY'S LAW PETITION?

 

  1. Book appointments with two (2) qualified health professionals (QHPs) two weeks (14 days) out.  One of the professionals MUST be a medical doctor.  A list of qualified health professionals known to perform these evaluations in Jefferson County can be found on pages 6 of the booklet.  Try to schedule the appointments for the same day.

 

  1. Call the prosecutor to relay the QHP appointment dates and determine when the official petition will be filed and when the court date will be scheduled. 

 

  1. File the petition at the Jefferson County Clerk’s Office on the designated date.

a) Bring the names, addresses, dates and times of the scheduled evaluation appointments.

b) Bring $40 (cash or check) payment for Sheriffs to serve the court summons on the Respondent.  (Please note that if the Respondent cannot be served, the petition will be dismissed.)

c) Bring a one (1)  page summary of the Respondent’s addiction history to include but not limited to:  the name(s) of the drug(s) abused, number of years abusing, changes in physical appearance and/or emotional temperament, health issues related to addiction, failed treatment programs, overdoses, criminal charges related to addiction, severed or abandoned relationships due to addiction, unemployment, homelessness, etc. 

 

  1. Attend evaluation appointments with the Respondent. 

 

  1. Return completed evaluation certifications to the Jefferson County Clerk’s office with 24 hours of the evaluation appointments. Failure to comply with this deadline will result in a dismissal of the case

 

  1. Start looking for a treatment program for the Respondent to attend that fits within the professional evaluator’s recommendations.  Bring the name, address, phone number and contact name of the selected treatment facility/program to court on the scheduled court date.

 

  1. Attend the Casey’s Law court hearing to testify that the Respondent is: 1. addicted to alcohol and/or drugs; 2. is a danger to self or others; and, 3. will benefit from treatment.  Be prepared to tell the judge if you (or your chosen agent) will be transporting the Respondent to treatment or if you will be paying the Jefferson County Sheriff’s Department to transport.
