The Louisville Metro Air Pollution Control District (APCD) has issued a response to comments received during the comment period for the Advanced Notice of Proposed Rulemaking (ANPR) for APCD Regulation 5.15, Chemical Accident Prevention Provisions. The comment period was held from May 27 to August 25, 2020.

Oct 8 2020 Air Pollution Control District Proposed Permit

The Louisville Metro Air Pollution Control District (District) proposes to issue a construction permit to Rohm and Haas – Louisville Plant (produces various coatings and resins), 4300 Camp Ground Road, in accordance with Regulation 2.03. This permit is being issued to incorporate Federal Regulation 40 CFR 61 Subpart FF – National Emission Standard for Benzene Waste Operations (BWON). The 30-day public comment period starts on October 10, 2020, and ends on November 9, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

The Louisville Metro Air Pollution Control District (District) proposes to issue a FEDOOP operating permit to AarhusKarlshamn (AAK) K1 (bleaches, hydrogenates, deodorizes, and refines soybean oil), 2520 South 7th Street, Louisville, KY 40208 in accordance with Regulation 2.17. This permit is being issued as administrative permit revision incorporating construction permit C-0291-0011-20-F. The 30-day public comment period starts on September 29, 2020, and ends on October 30, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Sep 25 2020 Air Pollution Control District Proposed Permit

The Louisville Metro Air Pollution Control District (District) proposes to issue a FEDOOP operating permit for Eurofins Genomics LLC (genomics lab), 12701 Plantside Drive, Louisville, KY 40299 in accordance with Regulation 2.17. This permit is being issued to incorporate Construction Permit C-1849-0001-20-F into the FEDOOP. This construction permit was issued to install three production CFS-384 synthesizers and one R&D CFS-384 synthesizer. The 30-day public comment period starts on September 26, 2020, and ends on October 26, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

The Louisville Metro Air Pollution Control District (District) proposes to issue a FEDOOP operating permit for Frontier Logistical Services, LLC (bulk liquid chemical distribution facility), 3601 Ralph Ave., Louisville, KY 40211 in accordance with Regulation 2.17. This permit is being issued to renew the operating FEDOOP permit. The 30-day public comment period starts on September 25, 2020, and ends on October 26, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

The Louisville Metro Air Pollution Control District (District) proposes to renew a FEDOOP operating permit to Anderson Finishing Solutions, Inc. (wood furniture coating operation), 3138 Del Park Terrace, Louisville, KY 40211 in accordance with Regulation 2.17. This permit is being issued as the regularly scheduled permit renewal and Anderson Finishing Solutions, Inc. has applied to be exempt from STAR regulations. The 30-day public comment period starts on September 22, 2020, and ends on October 23, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

The Louisville Metro Air Pollution Control District (District) proposes to issue a construction permit to The Chemours Company FC, LLC (manufactures refrigerant gases), 4200 Camp Ground Road, in accordance with Regulation 2.16. This permit is being issued to construct two new storage tanks and associated piping components to store raw material chloroform. The 30-day public comment period starts on September 13, 2020, and ends on October 13, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Aug 27 2020 Air Pollution Control District Proposed Permit

The Louisville Metro Air Pollution Control District (District) proposes to revise an operating permit for GE Appliances, A Haier Company – Appliance Park (home appliance manufacturing operation), 4000 Buechel Bank Road, Louisville, 40031, in accordance with Regulation 2.16. This revision incorporates two construction permits, four insignificant activities, one declaration of operational flexibility and removal of equipment. The only activity that is being public noticed is the addition of a case-by-case insignificant activity approval of the Markforged Metal-X 3D printer, Wash-1 debinder, and Sinter-1 sintering furnace, per Regulation 2.16 section 1.23.1.2. The 30-day public comment period starts August 29, 2020, and ends on September 29, 2020.  A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Aug 20 2020 Air Pollution Control District Proposed Permit

The Louisville Metro Air Pollution Control District (District) proposes to renew a FEDOOP operating permit for Preferred Marketing Solutions, Inc. (Lithographic Printing Operation), 2001 Papa John’s Blvd., KY 40299 in accordance with Regulation 2.17. This is a standard permit renewal, additionally, the pizza dough making operation has been removed, and greenhouse gas requirements have been removed from general conditions as they are not applicable. The 30-day public comment period starts on August 21, 2020, and ends on September 21, 2020. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

The Louisville Metro Air Pollution Control Board will hold a public hearing, via Video Teleconference due to the COVID-19 outbreak, on Agreed Board Orders with Kelley Construction, Inc. and Al J. Schneider Company. The companies are alleged to have violated District Regulation 5.04 (Adoption of Federal Emission Standard for Asbestos) at the Galt House Hotel located in Jefferson County, Kentucky.

Aug 6 2020 Air Pollution Control District Notice of Public Meeting

The Louisville Metro Air Pollution Control District (the District) announces a Public Meeting regarding possible amendments to Regulation 5.15, Chemical Accident Prevention Provisions.

The public meeting will provide a forum to share information about this regulation and to informally discuss possible amendments and answer questions from the public. This meeting will be held via teleconference (due to the COVID-19 outbreak) from 6:00 to 7:30 p.m., or until discussion ends (whichever is first) on August 20, 2020. Instructions on attending the teleconference will be posted at www.louisvilleky.gov/APCD/Docket before the meeting and emailed to subscribers of APCD Public Notices (www.louisvilleky.gov/government/air-pollution-control-district/subscribe...).

Aug 6 2020 APCD Releases Final Report of the Multipollutant Stakeholder Group

The Air Pollution Control District is releasing the Final Report of the Multipollutant Stakeholder Group convening process, which kicked-off in November 2019 and completed in April 2020. Through this process, more than 60 representatives from over 36 entities or organizations came together to receive up-to-date information about Louisville’s air quality challenges and collaboratively develop more than 90 recommendations for the APCD and the community-at-large to advance local air quality goals. While much focus was given to ozone pollution – for which Louisville is not meeting the current national standard – the group expanded its discussion and looked for opportunities to reduce emissions of fine particulates and air toxics, as well as recommended strategies to reduce exposure and increase awareness of the importance of protecting our air quality.
