Retailers selling tobacco, electronic smoking products, must apply for a city license by Jan. 1

Effective January 1, 2022, retailers who sell any type or amount of tobacco or electronic smoking products or devices will be required to have a license to operate in Louisville. This new license was approved and enacted by Metro Council on April 1, 2021 with an amendment to Louisville’s Smoke-free ordinance (90.11).

The new license allows the Louisville Metro Department of Public Health and Wellness (LMPHW) to track smoke-free ordinance violations more easily including any related to youth access to tobacco products. It will also help ensure compliance with zoning changes that reduce density of retailers and don’t allow new businesses to operate within 1,000 feet of any facility that serves children, such as libraries and community centers.

The license costs $10 and will be renewed annually, expiring on Dec. 31 of each year, requiring renewal by Jan. 1 of the next year. Businesses that change addresses or ownership must apply for a new license. Initial applications will also include a one-time $25 fee for a zoning check.

LMPHW will issue licenses and conduct enforcement. Louisville Metro Planning and Design will be providing zoning checks for these businesses. Reminders will be sent to retailers annually for renewal.

The Department of Public Health and Wellness will be sending communications about the new license to retailers over the next several weeks.
