Notice of Action on a Title V Construction Permit

The Louisville Metro Air Pollution Control District (District) proposes to issue a construction permit to Clariant Corporation (Louisville West Plant) (catalyst manufacturer), 1227 South 12th Street, in accordance with Regulation 2.03. The 30-day public comment period starts on February 29, 2024, and ends on April 1, 2024. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Copies of the application are available upon request. Written comments will be accepted through the District’s online public comment form until midnight or at the District office until 5:00 p.m. on April 1, 2024.

  1. What is the purpose of this permit? Construction Permit C-0036-23-0027-V is being issued to repurpose two reactors to eliminate NOX emissions and regulate PM, copper, and nitric acid emissions, construct two new hopper/conveyor systems, and replace three material grinders, two conveyors, and two vibratory feeders as part of the plant’s standard practices for the proper operation and maintenance of equipment.
  2. Will this permit increase pollution? Construction Permit C-0036-23-0027-V will decrease potential emissions of NOX by 16.68 tons per year and increase potential emissions of PM by 0.000802 tons per year, copper by 0.000428 tons per year, and nitric acid by 0.000229 tons per year. There are no changes in emissions or controls for the equipment replacement.
  3. Does this facility have a history of non-compliance? The last notice of violation was in 2022 for failure to comply with permit conditions in the Title V operating permit. This violation was resolved with Agreed Board Order 22-01, and the source is currently operating in compliance. See the Compliance History table in the Statement of Basis, page 14.
  4. Where can I find out more? Additional information, including equipment descriptions, potential emissions, and applicable rules, are summarized in the Statement of Basis. The Draft Permit details the application of these rules to the equipment and includes the monitoring, recordkeeping, and reporting that the District believes is necessary to demonstrate compliance.
