Informal Review for APCD Regulations 2.09 and 6.45

The Louisville Metro Air Pollution Control District (APCD) respectfully requests your informal review and comments before the start of the formal public review process for proposed revisions to:

Regulation 2.09 Causes for Permit Modification, Revocation, or Suspension, Version #3, Draft #1

Regulation 6.45 Standards of Performance for Existing Solid Waste Landfill, Draft #1

Draft regulations and proposed Preliminary Regulatory Impact Assessments may be found at the following website: http://www.louisvilleky.gov/APCD/docket.

APCD is proposing to amend Regulation 2.09 to correct and clarify language and cross-references. APCD is also proposing to repeal Regulation 6.45 since the date is no longer applicable and the entire facility is now subject to 40 CFR 60 Subpart WWW.

Informal comments will be taken until Friday, July 13, 2015. Please submit your comments to Stacey Barbro, by mail at Air Pollution Control District, 850 Barret Avenue, Louisville, KY, 40204-1745, by FAX at (502) 574-7239, by e-mail at stacey.barbro @ louisvilleky.gov or electronically at comment on a proposed regulation. Consideration of this draft regulation at a meeting of the respective Strategy or Policy Committee of the Air Pollution Control Board will be scheduled for Wednesday, July 15, 2015. Upon approval of the respective Strategy or Policy Committee, the APCD will publish a legal notice announcing the Public Comment Period and Public Hearing.

The following table identifies the date of the committee meeting, anticipated date of the legal notice, anticipated date of the Public Hearing, anticipated date on which the District will recommend that the Board take formal action on the regulation, and the APCD staff member and direct telephone number with whom to discuss the draft regulation.
