APCD Notice of Public Hearing
On February 17, 2021, at 10:00 a.m., the Louisville Metro Air Pollution Control Board will hold a Public Hearing on an Agreed Board Order to resolve a Notice of Violation (NOV) issued by the Louisville Metro Air Pollution Control District to the Louisville Metropolitan Sewer District (MSD) for violations of District Regulation 1.13; Control of Objectionable Odors. This NOV is related to odor complaints primarily from residents in the Chickasaw, California, and Park DuValle neighborhoods during July and August 2019. Residents complained to the District approximately 46 times during this time period of odors they described as “rotten eggs,” “feces,” and “sewage.”
The proposed Agreed Board Order requires MSD to take multiple actions to comply and to prevent the re-occurrence of these types of violations. These actions include:
- Developing and implementing an Odor Control Master Plan to address odors from MSD’s operations, including the Morris Forman Water Quality Treatment Facility and the Combined Wastewater/Stormwater Collection System;
- Developing and implementing a plan for improving communications between MSD and the public;
- Providing a publicly available Collection System cleaning and maintenance schedule and monthly odor complaint and corresponding response/resolution log on its website; and
- Repairing, rebuilding, or modifying 109 catch basins in the Park DuValle neighborhood that are untrapped and may allow objectionable odors to enter the ambient air.
The Air Pollution Control Board will consider adoption of this Agreed Board Order at the regularly scheduled monthly Board Meeting immediately following this Public Hearing.
