APCD Notice of Public Hearing
On February 17, 2021, at 10:00 a.m., the Louisville Metro Air Pollution Control Board will hold a Public Hearing on an Agreed Board Order to resolve a Notice of Violation (NOV) issued by the Louisville Metro Air Pollution Control District to Kosmos Cement Company LLC (Kosmos) for violations of District Regulation 2.16, Title V Operating Permits. This NOV is related to the company’s compliance with Part 63, Subpart LLL (National Emissions Standards for Hazardous Air Pollutants from the Portland Cement Manufacturing Industry), which establishes an emissions limit for Mercury (Hg) of 55 lbs/MM tons of clinker calculated as a 30-day rolling average on an operating day basis for the facility. Between May 26, 2020, and June 10, 2020, the company exceeded the limit on 16 operating days. The company returned to compliance thereafter. At its highest, on June 5, 2020, emissions of Mercury were 68 lbs/MM tons of clinker.
The proposed Agreed Board Order requires Kosmos to pay a civil penalty of $37,500.
The Air Pollution Control Board will consider adoption of this Agreed Board Order at the regularly scheduled monthly Board Meeting immediately following this Public Hearing.
