Notice of Public Comment Period on a Construction Permit

The Louisville Metro Air Pollution Control District (District) proposes to issue a construction permit to Clariant Corporation (Louisville West Plant) (catalyst manufacturer), 1227 South 12th Street, in accordance with Regulation 2.03. This permit is being issued to reflect previously unpermitted changes and/or modifications made by the facility. The related violations by the facility were addressed in Agreed Board Order 22-01. The 30-day public comment period starts on May 14, 2022, and ends on June 13, 2022. A public hearing may be scheduled if the District determines that there are germane, unresolved issues or substantial public interest, in accordance with Regulation 2.07.

Copies of the application are available upon request. Written comments will be accepted through our online comment form until midnight or at the District office until 5:00 p.m. on June 13, 2022.

  1. What is the purpose of this permit? The purpose of this permit is to make changes and/or modifications to correct certain reported permit deviations that included previously unpermitted equipment, changes in control devices, and other changes in operations that should have been reported to the District. The permit deviations were addressed with Agreed Board Order 22-01.
  2. Will this permit increase air pollution? This permit authorizes construction of new equipment. The permit will continue to limit plantwide emissions below major source thresholds (100 tons/year of criteria pollutants, 10 tons/year single HAPs, and 25 tons/year total HAPs).
  3. Does this facility have a history of non-compliance? This facility has had compliance issues, most recently addressed in February 2022 with Agreed Board Order 22-01. An overview on the facility's recent compliance history can be found on page 34 of the Statement of Basis.
  4. Where can I find out more? Additional information, including emissions units, potential and past actual emissions, applicable rules, and air pollution control equipment, are summarized in the Statement of Basis. The Draft Permit details the application of these rules to the emissions units and air pollution control equipment and includes the monitoring, recordkeeping, and reporting that the District deems is necessary to demonstrate compliance.
