Air Pollution Control District Advanced Notice of Proposed Rulemaking/Opening of Informal Comment Period
The Louisville Metro Air Pollution Control District (the District) is giving this Advanced Notice of Proposed Rulemaking, and opens an informal public comment period May 27, 2020, on amendments to Regulation 5.15, Chemical Accident Prevention Provisions.
An advance notice of proposed rulemaking (ANPR) is a notice intended to solicit information from the public as the District considers proposing a future rule. If the District determines amendments are warranted, it may formally recommend amendments to the Strategy Committee of the Louisville Metro Air Pollution Control Board to be formally proposed and released for a formal public comment period at a later date. In this ANPR, the District is soliciting informal comments on amending the regulation to incorporate by reference the federal Chemical Accident Prevention Provisions found at 40 CFR Part 68.
This ANPR opens a 90-day informal public comment period, from May 27, 2020, to August 25, 2020. During this period informal comments will be accepted by email to the Board Secretary-Treasurer, Rachael Hamilton, at 701 West Ormsby Avenue, Louisville, Kentucky 40203 or by email at [email protected].
During this period LMAPCD intends to host multiple open public meetings, which shall serve as question-and-answer sessions with the public. While comments from the public are welcome in writing during the informal comment period, the public meetings are intended as an opportunity for the public to ask questions about the ANPR, and the RMP Program more generally, and to interact with LMAPCD on a more informal level. The first public meeting is intended to be held in mid-June via teleconference (due to the COVID-19 pandemic) and will be announced separately. Additional public meetings will be scheduled as needed, either by teleconference or in person as conditions allow. Feedback on how best to reach the public is also welcome.
