Board of Zoning Adjustment (BOZA)

The Board of Zoning Adjustment, commonly referred to as the BOZA, consists of 7 members, all of whom are appointed by the Mayor subject to the approval of the Metro Council. The BOZA was established by state statute (KRS Chapter 100).

The Board conducts regular and special meetings as it deems necessary. Four members of the Board shall constitute a quorum.

What types of applications does the Board review?

The Board acts on the following application types:

  • Conditional Use Permits. A conditional use is a use specifically named in the Land Development Code which may be limited to specific locations and/ or by the requirement that certain conditions be met. Such conditions may be set forth generally in the zoning regulations and/ or may be specifically established on a case-by-case basis by the Board. Such conditions may include limitations on the hours of operation and other time limitations, and other requirements of a continuing nature as well as requirements which are made a condition precedent to the construction of a building or the commencement of a use.
  • Dimensional Variances. A variance is a departure from the terms of the form district regulations pertaining to height or width of structures and size of yards and open spaces, where such departure An appeal may be filed by any person or entity claiming that an official action or decision of any zoning official is in error.
  • Changes in Nonconforming Uses.
  • Miscellaneous Reviews. The Board may also review a waiver and/or a development plan application if attached to a conditional use permit or variance application.
