ABC Hearing Board
The Louisville Metro Alcoholic Beverage Control Board conducts administrative hearings pursuant to KRS 13B for local alcoholic beverage control licensees, commonly referred to as ABC licensees. The ABC Board also hears violations of ground transportation companies, or "certificate holders" and taxi drivers who have been charged with violating Louisville Metro ordinance(s). The recipient of an order to show cause (OTSC) or notice of violation (NOV) must appear before the hearing officer on the date and time provided.
The ABC Hearing Board has the authority to:
- Adopt rules and regulations to govern its operation and conduct its hearings.
- Determine if a violation of an ABC ordinance over which it has jurisdiction was committed.
- Subpoena alleged violations, witnesses, and evidence to its hearings.
- Hear testimony.
- Make findings of fact and issue orders necessary to remedy any violation of the Metro ordinance.
- Impose civil fines.
The ABC Hearing Board meets every other Tuesday at 1:00 pm until complete.

FAQS
Am I required to bring an attorney to the ABC Hearing Board?
Yes. A person who is not an attorney is prohibited by law from representing a corporation (such as an LLC) at an administrative hearing.
However, if you are a sole proprietor, you are not required to have an attorney but you have the right to have an attorney or any witnesses with you to help you support your claim that the notice of violation was issued in error.

What if I arrive late to the hearing? Will I be allowed into the boardroom?
Yes. The hearings are open to the public and you may come and go in a quiet fashion. If you arrive late and after your case has been called, your case will be moved to the end of the docket. If you fail to appear for your scheduled hearing, you forfeit your right to appeal and your penalty may be set at the maximum amount allowed.
What if I follow the appeals process and I am unsatisfied with ABC's decision in my case?

Why am I required to turn off all cell phones and pagers before entering the Hearing Room?
Cell phones, pagers, laptops, and personal data assistants (PDAs) operate on frequencies that may disrupt the Board Room audio and visual equipment, as well as the hearing.
