Make an APCD Open Records Request
As the regulatory agency for air pollution in Louisville/Jefferson County, the APCD maintains records documenting its activities. The APCD makes these records available to the public under Kentucky Revised Statutes (KRS) 61.870-61.884, the Open Records Policy of Louisville Metro Government, and APCD Regulation 1.08.
How do I file an open records request to the APCD?

What if I am requesting records for an Environmental Site Assessment?
When requesting records for an Environmental Site Assessment, please be advised a Commercial Purpose form must be completed and notarized. Scan and attach the certified form when filing the Open Records Request. A fee will be issued according to the provisions of KRS 61.874(4) that must be paid prior to the release of any responsive records.
What if the records provided are to be utilized for a commercial purpose?
You may complete the general open records request online and attach a scanned and notarized copy of the commercial purpose form as a file. Please have the officer of your corporation with signatory authority complete the “Certification of Commercial Purpose” form, if the records provided are to be utilized for a commercial purpose, as set forth in KRS 61.870(4)(a) as: “…the direct or indirect use of any part of a public record or records, in any form, for sale, resale, solicitation, rent, or lease of a service, or any use by which the user expects a profit either through commission, salary, or fee.”
How long will it take to receive the documents?
APCD staff will respond to you within five business days to inform you when the documents will be made available.

What records may not be available?
Not all of APCD records are available for public inspection. Certain types of records qualifying for exemption are listed in KRS 61.878.
- APCD records are often organized by company name and street address – please include this information in your request.
- Always include a date or date range.
- Be as specific as possible in describing the requested records.
- Fill out and notarize a Commercial Purpose form before submitting a Phase I Environmental Site Assessment.
